Offer Terms

These terms apply to the promotional offers on this website made by Brillo AYS Pty Ltd ACN 695 831 059, trading as BAYS (BAYS).

1. All offers

Every offer is available on application only.
BAYS assesses each application on a case-by-case basis. Whether an offer is made, and its scope, value, duration and conditions, are at BAYS' discretion.
An offer applies only when BAYS confirms it in writing. The written confirmation states the offer, its conditions and any period it applies to.
Offers cannot be exchanged for cash, transferred to another person or property, or combined with another offer, unless BAYS agrees in writing.
BAYS may change or withdraw an offer at any time. A change or withdrawal does not affect an offer BAYS has already confirmed in writing.
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

A review of an owners corporation's levies, budget, capital works fund and arrears, based on the documents provided to BAYS.
The check is free of charge and carries no obligation to appoint BAYS.
The check is not an audit.

Between one and three months of building management fees waived on a new building management appointment.
BAYS decides the number of bonus months for each building, having regard to the building and the term of the appointment. The number and the months it applies to are stated in the written confirmation.

BAYS adds no mark-up to the charges of contractors it arranges under a facilities management appointment. Contractor charges are passed on at the contractor's price.
BAYS' own management fees under the appointment still apply.

Strata scheme set-up and initial-period management at no cost to the developer, for projects BAYS accepts.
The scope of the set-up is stated in the written confirmation. The strata readiness consultation is a separate, paid service.

Access to the ASOS platform without a licence fee, on application.
Eligibility, the features and number of users included, and the period of free access are set by BAYS for each applicant and stated in the written confirmation.
Use of ASOS is also subject to the ASOS terms of use.

BAYS pays the professional fee of its partner conveyancer for one transaction per property.
Searches, government charges and other disbursements are payable by the client.
Conveyancing services are provided by the partner conveyancer under its own terms of engagement. BAYS does not provide legal or conveyancing services.

The comparison is provided by BAYS' partner mortgage broker, who is paid by the lender. There is no charge to the borrower for the comparison.
BAYS does not provide credit assistance.

BAYS may receive a referral fee from its partner real estate agents, conveyancer and mortgage broker. BAYS discloses the partner and the amount of any fee in writing before the client proceeds.
